THE 2007 JAMES PATTERSON PAGETURNER AWARDS
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT IMPROVE YOUR CHANCE OF WINNING.
Eligibility for nomination: The Third Annual James Patterson PageTurner Awards (the "Awards") are open for applicants who are: (1) individuals who are legal residents of the 50 United States or the District of Columbia and who are 18 years of age or older at the time of entry, (2) organizations, companies, schools, bookstores, libraries, book clubs, philanthropic organizations ("Organizations") based in the 50 United States or the District of Columbia and (3) individuals who are legal residents of Canada (excluding Quebec) and Organizations based in Canada (excluding Quebec). Employees of James Patterson ("Sponsor"), Hachette Book Group USA, Inc., and their respective parents, subsidiaries, affiliates, retailers, suppliers, distributors, advertising/promotion agencies, and their immediate family members (mother, father, brothers, sisters, sons, daughters and spouse) and/or those living in the same household, whether or not related, are not eligible to enter or win ("Award-Related Persons"). The Awards are void where prohibited by law.
Nominations/Applications: Nominators may nominate an unlimited number of people and/or Organizations. Applicants may be nominators and/or nominees. A nominator may nominate him/her self. A nominee need not apply. An applicant need not be nominated in order to apply.
Sponsor must receive all nominations no later than Sunday, December 9, 2007 at 11:59 PM ET. Sponsor will use reasonable efforts to notify nominees promptly after receipt of the first nomination of an individual or Organization, using the email address provided by the nominator (or if none is provided by the nominator, the street address provided by the nominator).
How to Apply: To apply for an Award (whether or not nominated), visit www.pattersonpageturner.org (the "Website") between 12:01 a.m. EST on Saturday, June 2, 2007 and 11:59 p.m. ET on Sunday, December 16, 2007 (the "Submission Period"), and complete and submit to the Website the appropriate online application form. Limit is one (1) application per applicant and per e-mail address or one (1) application per Organization per email address. In case of multiple applications from the same person or Organization, only the first received application from the person or Organization will be accepted. Each application submitted must be completed in full (and any application which, in Sponsor's good faith judgment, is not complete will be disqualified).
Application Forms: Application forms include a request for a written essay describing what the applicant has done to spread the excitement and joy of books and reading to others. Application forms also include a request for references. References should not include persons related to the applicant, but may include a nominator. Applicants hereby give permission for Sponsor or Administrator to contact references concerning applicant.
Applications must be received by the end of the Submission Period. The Website's database clock will be the official timekeeper for the Awards. No revision or substitution of an application will be accepted under any circumstances once the original application is submitted. Applications become the exclusive property of Sponsor and will not be returned or acknowledged. Proof of submission of the application is not considered proof of delivery to or receipt of such application by Sponsor. Sponsor shall not have liability for any application that is lost, intercepted, delayed or not received by Sponsor, for any reason.
Awards Selection: At the end of the Submission Period, a group consisting of Sponsor's designees and executives of Hachette Book Group USA ("judges") will review and judge the Submissions in each of the three (3) categories listed below and select the winning Submissions to be awarded in each category from among all eligible applications in that category, using the following judging criteria:
(1) Scale of impact on public (25%);
(2) Quality of impact on public (25%);
(3) Originality of work (20%);
(4) Quality and scope of references and/or press coverage (20%);
(5) Power of essay to convey relevant work or activities (10%).
In the event of a tie for any award, the affected Submissions will be reviewed by Sponsor or his designee who will judge the Submissions according to the criteria listed above and break the tie.
The winning Submissions will be selected on or about March 15, 2008 by the judges, whose decisions will be final and binding. Winners will be notified by telephone, email, and/or mail using the contact information provided at the time of application. In addition, if Sponsor elects, the announcements also may be posted online at the Website. Sponsor shall have no liability for any winner notification that is lost, intercepted, delayed or not received by the potential winner for any reason.
PageTurnerAwards in the following categories, consisting of a check payable in U.S. Dollars to the winner, will be as follows:
United States/D.C. Awards to Individuals:
One (1) award in the amount of $25,000.
Five (5) awards each in the amount of $5,000.
Five (5) awards each in the amount of $2,500.
United States/D.C. Awards to Organizations:
One (1) award in the amount of $50,000.
Two (2) awards each in the amount of $25,000.
Five (5) awards each in the amount of $5,000.
Fifteen (15) awards each in the amount of $2,500.
One (1) award in the amount of (US) $20,000.
Two (2) awards each in the amount of (US) $2,500.
Total amount of all Awards: (USS) $250,000.
In the event that Sponsor receives an insufficient number of Submissions in any category and/or for a particular Award, Sponsor in its sole discretion may decline to make a particular Award in that category.
General Award Conditions: Awards will be made only if the potential winner fully complies with these Official Rules. No interest will be paid on awards. Award winners will be responsible for all taxes that may become payable as a result of the awards (federal, state, city, province, sales), as well as the proper reporting or declaration of income and payment of taxes and related costs, including interest and/or penalties, to the appropriate governmental authority(ies). Sponsor may be required to withhold all or a portion of the Award to award winners who are subject to Canadian law. Awards are non-transferable and non-assignable. All matters related to the Awards, and all details and other restrictions not specified in these Official Rules will be determined by Sponsor in his sole discretion. Each potential award winner will be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release (collectively "Awards Claim Documents") within (5) five days of issuance of notification. If the winner is considered to be a minor in his or her state or jurisdiction of residence, at Sponsor's option, the applicable award will be awarded to the minor winner's parent or guardian on behalf of the winner, and the parent or legal guardian of the minor winner will be required to ratify and sign Awards Claim Documents. Non-compliance with the foregoing may result in disqualification and awarding of award to an alternate winner. If any award notification letter or award is returned as undeliverable, winner will be disqualified and an alternate winner may be selected. Confirmation of award winners is subject to Sponsor's verification of the Awards Claim Documents.
Anticipated Number of Applicants: Sponsor cannot accurately predict the number of applicants in each category or in total who will participate.
Warranties; Publicity Release; License to Use: By participating in the Awards, each applicant warrants and represents that the Submission is original to the applicant and does not violate the law or violate or infringe upon the rights of any person or entity. By participating in the Awards each applicant irrevocably grants the Awards-Related Persons and their respective successors, assigns and licensees the right to use such applicant's name, likeness, biographical information and/or the applicant's Submission, in whole or in part, in any and all media for any purpose, including without limitation advertising and promotional purposes, as well as in, on or in connection with the Awards and/or other promotions conducted by the Award-Related Persons, and each applicant hereby releases the Award-Related Persons from any liability with respect thereto. Sponsor shall have the right, in its sole discretion, to edit, publish, or otherwise use each Submission, in whole or in part, for any purpose which Sponsor deems necessary or desirable (including, without limitation, posting on the Website), and each applicant irrevocably waives any and all so-called moral rights they may have therein.
No Obligation to Use: Sponsor shall have no obligation (express or implied) to use any Submission, or if commenced, to continue to use or distribute it, and Sponsor may at any time abandon the use and/or distribution of the Submission for any reason, with or without legal justification or excuse, and applicant shall not be entitled to any damages or other relief by reason thereof.
Further Documentation: If Sponsor desires to secure additional documents in order to effectuate the purposes and intent of these Official Rules, then each applicant agrees to sign the same upon Sponsor's request therefor.
General Liability Release/Force Majeure: Entrants (or if minors, their parents or legal guardians) agree that the Award-Related Persons (a) shall not be responsible or liable for any losses, damages or injuries of any kind resulting from participation in these Awards or any Awards-related activity, or from entrants' acceptance, receipt, possession and/or misuse of the Award(s), and (b) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to the Award(s), including, without limitation, to such Award's quality or fitness for a particular purpose. Sponsor assumes no responsibility for any damage to a nominator's or applicant's computer system which is occasioned by accessing this or any other website or participating in the Awards, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen or postage-due Submissions or Award notifications; lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites or other connections; or for miscommunications, failed, jumbled, scrambled, delayed or misdirected computer, telephone or transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the sole discretion to disqualify any individual or Organization found to be tampering with the entry process or the operation of the Awards or this Web Site or to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Awards, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. In the event Sponsor is prevented from awarding Award(s) or continuing with the Awards as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man made epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state, provincial or local governing law, order, regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor's control (each a "Force Majeure" event or occurrence), then subject to any governmental approval that may be required, Sponsor shall have the right to modify, suspend, or terminate the Awards. If the Awards or a part of them are terminated for Force Majeure before the designated end date, Sponsor will (if possible) select the winner(s) from all eligible, non-suspect submissions received for the applicable category as of the date of the event giving rise to the termination. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
Governing Law/Jurisdiction: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF APPLICANTS, WINNERS OR SPONSOR IN CONNECTION WITH THE AWARDS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF NEW YORK WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE'S OR JURISDICTION'S LAWS.
Winners List: To obtain a copy of any legally-required Winners List, send a self-addressed, stamped envelope to The Third Annual James Patterson PageTurner Awards Winners List, c/o Hachette Book Group USA, Inc., 237 Park Avenue, New York, NY 10017, Attn: Alison Steedman. All requests must be received by Sponsor within six (6) weeks after the end of the Submission Period. Canadian residents may omit return postage.
